Fitness for Duty Evaluations: Helping Employers Make Safe Return-to-Work Decisions

Fitness for Duty Evaluations
When an employer has questions about an employee's ability to safely perform their job duties on a day-to-day basis, a Fitness for Duty Evaluation (FFD) may be helpful.
Having a clear medical opinion will help an employer determine whether an employee can safely return to work, requires reasonable accommodations or job restrictions, or is unable to return to work at this time.
What is the purpose of a FFD
The FFD examination is meant to:
- Comply with the Americans with Disabilities Act (ADA).
- Comply with the California Fair Employment and Housing Act (FEHA).
- Confirm whether an employee is medically able to perform their essential job functions safely.
An Independent Medical Evaluator can be utilized to:
- Request medical records for review
- Examine the employee's physical and/or psychological capacity to safely perform their job duties.
- Recommend additional testing needed before a medical opinion can be made
- Write a clear, objective report that explains whether an employee needs work restrictions, special accommodations, and whether they are able or unable to return to work.
