What is SIBTF?

The Subsequent Injuries Benefits Trust Fund is a source of additional compensation to injured workers who had a prior disability or impairment at the time of their work injury. The employee may be compensated for their industrial injury as well as for any pre-existing disability. The prior disability may be caused by industrial or nonindustrial accidents, warfare, illness, congenital defects, or by any other means that result in disability. The Legislature established this fund to encourage the hiring of handicapped persons in such a way that the employer’s liability is limited.

Who is Entitled to SIBTF Benefits?

Any injured employee with a prior disablement may be entitled to benefits, from the Fund, if the combined effect of the work injury and the earlier disablement equals a rating of 70%, or more, and either one of the following conditions is met:

  1. The prior disability was to any part of the body and the new injury (work injury) is one which rates 35% or more when considered alone and without regard to or adjustment for the age or occupation of the employee.
  2. The prior disability was to an eye, arm, hand, leg, or foot and the new injury (work injury) is to the opposite and corresponding member and rates 5% or more when considered alone and without regard to or adjustment for the age or occupation of the employee;
